§ 26-96-040. Action by board of supervisors—Abandonment or withdrawal of amendatory proceedings.

  • Upon receipt of a report from the planning commission or upon the expiration of the ninety (90) days as aforesaid, the board of supervisors shall set the matter for hearing and shall give notice thereof by one (1) publication within the county at least ten (10) days prior to such hearing. After conclusion of the hearing, the board of supervisors may adopt the proposed amendment or any part thereof in such form as the board may deem advisable. The decision of the board of supervisors, whenever practicable, shall be rendered within ninety (90) days after the receipt of a report and recommendation from the planning commission, except that after a four-fifths ( 4/5 ) vote, the board of supervisors may render its decision after ninety (90) days but within a reasonable time. Upon the consent of the planning commission, any petition for an amendment may be withdrawn upon the written application of a majority of all the persons who signed such petition. The board of supervisors or the planning commission, as the case may be, may by resolution abandon any proceeding for an amendment initiated by its own resolution of intention; provided, that such abandonment may be made only when such proceedings are before such body for considerable; and provided that any hearing of which public notice has been given shall be held.
